WHAT’S THE WEBINAR ABOUT?
In March 2024, the U.S. Environmental Protection Agency (U.S. EPA) published in the Federal Register the final Clean Water Act (CWA) Worst Case Discharge Planning regulations under 40 CFR 118. The rule requires subject facilities with CWA hazardous substances above the threshold quantity and within 0.5 mile of navigable waters to demonstrate that the facility will or will not be subject to the rule. Subject facilities will need to perform worst case discharge demonstrations. In this webinar, we will review what facilities should consider in determining whether or not they meet the applicability criteria and, if so, what next steps facilities should take to be in compliance by the June 1, 2027 deadline.
